No need to wait 6 months for divorce, Supreme Court verdict

Amaravati: A five-member constitution bench of the Supreme Court on Monday gave a key verdict simplifying the process of divorce. The Supreme Court held that there is no need to wait 6 months for divorce if the couple wants to separate by mutual consent. It has given a clear order to grant divorce immediately if the couple wants. According to Article 142, Supreme Court can grant divorce using special powers. Justice Kishan Kaul, Sanjeev Khanna, Abhay S.Oka, Vikram Nath, JK Maheshwari, Justice Kishan Kaul, Sanjiv Khanna, Abhay S.Oka, Vikram Nath and JK Maheshwari ruled that if husband and wife want to separate by mutual consent, there is no need to wait for six months.
Several petitions have been filed asking the Supreme Court to directly grant divorce without restricting the issue of divorce to family courts. The Supreme Court has inquired whether the Supreme Court can exercise its special powers under Article 142 of the Constitution in the case of divorce by mutual consent.
On June 29, 2016, these petitions were transferred to a five-member Constitution Bench. The bench, which heard these lawsuits at length, reserved judgment in September 2022. The verdict was delivered today.
